These Terms and Conditions (“Terms”) govern the sale of products through the website gigamarkit.com (the “Website”), operated by DIENNE S.R.L. By placing an order, you confirm that you have read, understood, and accepted these Terms in full. If you do not agree, please do not place an order.

These Terms are governed by Italian law and applicable EU consumer protection legislation, including Directive 2011/83/EU on consumer rights.

2. Eligibility

To place an order on our Website, you must be at least 18 years of age and be a resident of one of the countries we ship to. By placing an order, you confirm that you meet these requirements.

3. Products

We offer a range of consumer electronics, home appliances, and garden tools. Product descriptions, images, and prices are provided for informational purposes and are subject to change without prior notice. We make every effort to ensure accuracy, but we do not warrant that product descriptions are error-free.

We reserve the right to limit quantities and to discontinue any product at any time.

4. Prices

All prices displayed on the Website are inclusive of applicable VAT unless otherwise stated. Prices are shown in the currency applicable to the delivery country. We reserve the right to modify prices at any time; the price applicable to your order is the price displayed at the time you place the order.

5. Payment – Cash on Delivery (COD)

All orders are paid exclusively via Cash on Delivery (COD). Payment is made in cash directly to the courier at the time of delivery. No advance payment, card payment, or online payment is required or accepted through the Website.

By placing an order, you agree to be present at the delivery address to collect the parcel and pay the stated amount in cash. If you are not available, the courier may leave a notice for a re-delivery attempt. Repeated failed deliveries may result in the order being returned, and you may be charged for return shipping costs.

6. Order Placement and Confirmation

An order is placed when you submit the order form on our Website. You will receive an order confirmation by email shortly after. Order confirmation does not constitute acceptance; the contract of sale is concluded when the order is dispatched.

We reserve the right to cancel or refuse any order at our discretion, including in cases of suspected fraud, stock unavailability, or errors in pricing.

7. Delivery

Orders are delivered within 1–2 business days from order confirmation to all countries we serve. For full details, please refer to our Shipping Policy. Delivery times are estimates and may be affected by courier delays, public holidays, or events beyond our control.

8. Right of Withdrawal (Consumer Right to Cancel)

In accordance with EU Directive 2011/83/EU, if you are a consumer (a natural person acting outside your trade or profession), you have the right to withdraw from the purchase contract within 14 calendar days from the day you or a third party (other than the carrier) receive the goods, without giving any reason.

To exercise the right of withdrawal, you must inform us of your decision by email to info@gigamarkit.com before the 14-day deadline. You must then return the product within 14 days of notifying us, in its original condition and packaging.

Return shipping costs are at your expense unless the product is defective or we delivered the wrong item. Refunds will be processed within 14 days of receiving the returned product.

The right of withdrawal does not apply to: sealed products that have been opened after delivery and are not suitable for return for hygiene or health protection reasons; customised or personalised products; or perishable goods.

9. Warranties and Liability

All products sold on gigamarkit.com benefit from the legal guarantee of conformity as provided under EU Directive 1999/44/EC and its national implementations (2 years from delivery). If a product is defective or does not conform to the description, contact us at info@gigamarkit.com.

Our liability to you is limited to the purchase price of the defective product. We are not liable for indirect, incidental, or consequential damages arising from the use of our products or Website.

All content on the Website, including text, images, logos, and product descriptions, is the property of DIENNE S.R.L. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes arising from these Terms or any purchase made through the Website shall be subject to the exclusive jurisdiction of the courts of Avezzano (AQ), Italy, without prejudice to your rights as a consumer under applicable EU law.
